Access Systems America v. Hop-on: Hop-on Comments on Ongoing Trademark Dispute
Hop-on Claims that Access Systems America Blocks Efforts to Let USPTO Settle Graffiti Trademark Dispute
IRVINE, Calif., Feb 11, 2008 (BUSINESS WIRE) -- Hop-on, Inc. (Pink Sheets:HPNN) today announced that the company has yet to settle its ongoing trademark dispute with large Japanese conglomerate Access Systems America, Inc. aka Palm Source.
Peter Michaels, President of Hop-on, notes that Hop-on won the right to use the "Graffiti and Graffiti Wireless" trademarks for mobile phones at the USPTO.
According to Michaels: "Access Systems America filed their Graffiti trademark in the same category as Hop-on at the USPTO and opposed Hop-on's trademarks, even though they were aware that Hop-on had filed its 'Graffiti and Graffiti Wireless' trademarks first. They were also aware that Hop-on was already selling mobile phones bearing the Graffiti and Graffiti Wireless trademarks in commerce. To Hop-on's knowledge, from the time Access Systems America filed their opposition they have not used the Graffiti trademark in commerce for mobile phones.

Michaels contends that, rather than wait for the USPTO to resolve the "Graffiti and Graffiti Wireless" trademark disputes, Access Systems America went against normal industry practice and pursued a federal district court action on the same matter in hopes that Hop-on would not be able to financially bear the burden of the U.S. federal court system. Hop-on has decided to fight the dispute and plans to vigorously defend itself in the U.S. court system.
Michaels stated, "It's been noted that Access Systems America has a pattern of infringing on other company's intellectual properties. This is not an isolated incident. For instance, Access Systems America lost a lawsuit with Xerox in excess of $25 million for violating a Xerox patent."
